Illinois rules for a solar floor

Telemarketer registration

The research found no Illinois telemarketer registration requirement in the statutes it reviewed. No telemarketer registration in Illinois telephone solicitation or dialer acts. Confirm before dialing.

815 ILCS 305 and 815 ILCS 413 reviewed

Calling window

Illinois sets its own window: 8 a.m. to 9 p.m.; recorded message autodialers from 9 a.m. It covers live operator sales calls; autodialer rule covers recorded message calls. Set the dialer to the narrower of the state and federal windows.

815 ILCS 413/15(a); 815 ILCS 305/15(a)

Do not call list

The research found no separate Illinois do not call list. State registry repealed 2018; Attorney General points to national registry. The National Do Not Call Registry still applies.

815 ILCS 402 (repealed by P.A. 100-621); Illinois Attorney General fact sheet

Automated and recorded calls

Illinois has its own law on automated or recorded sales calls. Autodialer recorded sales messages need the called party's consent. It can be stricter than the federal rules.

815 ILCS 305/30(b)

Recording calls

Illinois requires the consent of all parties to record a call. Surreptitious recording of private conversations needs all parties' consent. Tell the homeowner the call is recorded before recording.

720 ILCS 5/14-2(a)(2)

Illinois limits live telephone sales calls to 8 a.m. to 9 p.m., limits recorded message autodialer calls to 9 a.m. to 9 p.m., points residents to the National Do Not Call Registry, and bars secretly recording private conversations without all parties' consent.

Illinois laws on solar sales

The research found no Illinois statute written specifically for residential solar sales. General consumer and contract law still applies.

Illinois gives buyers 3 business days to cancel covered home solicitation sales (sales of $25 or more made at the buyer's home). The Illinois Attorney General says buyers 65 or older get 15 business days to cancel home repair or remodeling sold at home by an uninvited solicitor. Whether a solar sale counts as home repair depends on the facts. 815 ILCS 505/2B
